  • Can anyone help me here? My work has screwed me over. Breakdown:

    Initially with 2 part time jobs, i left one to become full time at my current place when another fella left. Initially my contract was 25 hours per week (part time remember) and requested my boss to uprade the contract to match the full time hours I was now doing (40). She said she’d do it. This was in Feb ’05.

    Came into work last week and my hours have been cut to 25 because that’s what management say is on my contract. They’ve virtually made me redundant. I done some research and found this in a GNVQ paper:

    ‘The purpose of a contract, or statement of employment, is to set out the legal basis of the relationship between an employer and employee. A contract itself comes into force as soon as an offer of employment is accepted, even if the agreement is only verbal. It does not necessarily have to be written to constitute the formulation of a contract.’

    But I can’t find this on the Employment Right Act 1996. Does anyone know where it is or can give me advice regarding my treatment? Also a girl I work with who had 25 hours on her contract was given a full time contract last week even though she hasn’t signed anything and started the same week as I.

    My Mum’s cousin was a barrister in business law.. he’s now a judge i’ll get her to ask him for you…
    I know a fair bit about employment law due to having been a hotel manager for 6yrs and studying law as part of my degree but the problem is proving the verbal contract it’s your word against theirs… and if you haven’t been with the company for a year then i don’t think you can take them to a tribunal.. but i shall ask my mother and let you know if you like??

    if you are providing time and being paid, this forms the basis of a contract of employment

    but without anything in writing, you will have to go to a tribunal to make your case

    not good for you, but if you want to go through with it, you’ll have a case

    I’ve been with the company almost 18 months now.

    I took over from a fella called Chris. What I can provide is records the week he siezed his employment my hours increased to full time on a consistant basis until 2 weeks ago when the cut was made. I could also provide evidence that the week I began this full time employment I seized to continue working at my other part time job. Surely this must prove to a tribunal an offer of a full time position was offered to me, otherwise why would I leave the security of my other part time job?

    go to your local Citizen’s Advice Bureau

    they will be able to give you definate advice and may even provide you with practical support through a tribunal
