  • Ok, I need some information.

    Recently a friend of mine has been selling Nitrous Oxide to our mates and at parties. The police have found a few empty canisters lying around and have been trying to find out who’s been selling them (there was a front page story in the local paper, we’ve been asked by the community support officers about the canisters).

    He’s left for India for two months.

    They have some how found out our friend has been selling them, and we were told they they’re planning on “making an example of them”.

    This is quite worrying because I don’t want to see them getting fined or locked up.

    What I’d like to know is what sort of punishment he’s likely to receive?

    I know that NOS isn’t classed as an illegal substance, but it is illegal to inhale under the medicines act.

    can they prove all the canisters came from him? ill bet they cant. just tell your mate to get any excess cannisters out of his house once he gets back. I bet all the police have is someones word he was selling them. He can can eithier say nothing and let them try and prove all the cannisters came from him, which will be pretty impossible, or just say he takes nitrous personally, then say nothing. thats my advice anyway.

    They have no proof no, just word of mouth.
    He wouldn’t bother lying though, they have no hard proof but I doubt he’d stand up to them.

    This law governs the manufacture and supply of medicine. There are three categories:

    • Prescription Only drugs can be sold by a pharmacist if prescribed by a doctor <LI Pharmacy medicines may be sold by a pharmacist without prescription
    • General sales list medicines may be sold without a prescription in any shop

    Possession of Prescription Only medicines without a prescription is a serious offence. Drugs such as amyl nitrite, GHB and ketamine are regulated under the Medicines Act.

    what they are getting the sellers to youths under is the anti-solvent abuse laws set up in the 1980s when I was a teenager… might be the “Intoxicating Substances Act 1985″…

    It is illegal to sell the gas for use recreationaly – ie when it is in a balloon that someones gonna inhale, its not illegal to sell it in the wippets (for cooking purposes..) its also not illegal to posses/take it urself! So basically they need to prove he sold it to people to breathe, all he needs to say is he took them himself, without evidence more substantial that someones word (eg the police actualy catching him) they shuouldnt be able to charge or convict him of anything

    afaik hearsay is not admissable in court if the lawyer challenges it

    is amyl nitrate regulated? i didnt think it was… this might have changed tho.

    i dont think it would be, but i havent seen it available in shops for a while …

    The Law: This is currently undergoing revision to close a rather strange loophole. Currently, the use and possession of poppers in NOT illegal, but the law is complex.

    Poppers can be sold as ‘room odourisors’ but not inhalants, as this would classify them as a medicine and require a pharmacy to dispense them.

    If you got nabbed selling poppers as inhalants, you would be committing a civil offence and would be prosecuted by the Medicines Control Agency (part of the Department of Health).

    However, for those who desire to have your room smelling of old socks, poppers are still freely available from many sex shops and other outlets. Stock up on ’em while you can! In the US, nitrites have been banned since 1988.
