Gadget makers fear new copyright levies hurt sales By Lucas van Grinsven, European Technology Correspondent
AMSTERDAM (Reuters) - Electronics manufacturers railed against a European tax on recordable discs and music players like iPods on Friday, even as a Dutch industry group was getting ready to impose new local levies on recordable media.
Top executives of Nokia (NOK1V.HE: ) and Philips Electronics (PHG.AS: ) in an open letter published on Friday said that the tax on blank media, designed to compensate artists for private copying, was out of date and that many consumers were already paying twice as they purchase digital content legally on the Internet and subsequently store it on a recordable compact disc.
Nokia Multimedia chief Anssi Vanjoki, Philips Consumer Electronics head Rudy Provoost and others urged the European Commission to reform the "antiquated system of rough justice" as the law comes up for evaluation this year.
Also on Friday, electronics producers in the Netherlands said they were at stalemate in talks with the entertainment industry and that the chairman of their joint industry group SONT is ready to set levies for new devices in the country.
These would mean an mp3 player like an Apple (AAPL.O: ) iPod would cost 25 euros ($32) more and a hard disk TV recorder 80 euros, the electronics industry's lawyer, Dirk Visser, said.
"This will lead to double or triple taxation. Soon, a consumer will pay rights to the artists when he buys on iTunes, then again when he buys a blank disc and undoubtedly it will be extended to mobile phones which can also store music," he said.
SONT Chairman Henk Vonhoff was not immediately available to comment, but a representative for the Dutch entertainment industry said that no decision had yet been taken to implement new levies for new devices such as iPods.
"The chairman has to execute the law (which says that blank media need to be taxed), but whether the levy will be one or 100 euros still needs to be discussed," said Paul Solleveld of Dutch entertainment industry organization NVPI.
The 1.2 billion euros charged in EU-directed copyright levies on digital media and equipment in 2005 actually cost the community an extra 2.1 billion euros in missed sales, according to a study from the Copyright Levies Reform Alliance (CLRA).
EU states where it is imposed -- some countries such as Britain have no levy on blank discs -- are expected to collect 1.57 billion euros this year and 2.12 billion in 2009.
If disputed, additional local levies in the Netherlands, Austria, Germany and Spain were introduced, the amount collected would rise to 4.67 billion euros in 2009, according to the CLRA.
Meanwhile, distribution of the money in the Netherlands among artists has led to huge delays and complaints, and an investigation ordered by the Justice Ministry was full of criticism of the system in its report in December 2005.
The levy itself dates back to the 1960s, when it was introduced on blank tapes to compensate performers for private copying of copyrighted music.
The European Commission will publish its views by the year end, but could meet resistance to change from individual states as a third of the money raised goes to government coffers to promote cultural activities.

Complaints are piling up against the Pinal County Sheriff's Department after deputies shut down an art festival known as "Glow." It took place last weekend on the Triangle L Ranch in Oracle, which has hosted the annual art and music festival for three years.
"What Glow is all about is basically a celebration of life and light, nondenominational, just a celebration of creativity," says Glow volunteer Dave Squires.
Artists from all over Southern Arizona bring their work here. Hundreds of people gather for music, friendship, food and fun.
"It's an annual family art event," says Mike Spence of Triangle L Ranch. "There's kids from 8 to 80 who just show up and have a wonderful time."
But the festivities came to an abrupt end when seven to eight deputies put a stop to the party Saturday night.
"It really was a shock," says Squires. "Basically, I think that they thought it was a rave with a lot of underage kids on drugs or something. It was just the opposite. It was a family event."
With an estimated 600 people in attendence, parking became an issue. Deputies say all those cars were blocking the road outside the ranch. But many participants say one deputy in particular overstepped his authority, and now at least 50 complaints have been made to the department.
"He got behind the microphone and told everybody this was an illegal gathering, and that we had to leave immediately or else be arrested," Squires says. "It really was a shock."
But despite what happened, organizers say they hold no animosity towards the Pinal County Sheriff's Department. They even had a one-on-one meeting with the sheriff himself.
"I was impressed with his sincerity," Spence says. "I'm confident he's going to make corrections that need to be made, and he's going to help us next year."
The Pinal County Sheriff's Department is conducting its own investigation. One of the deputies involved is on desk duty while the investigation proceeds.
The department has called a public meeting to discuss the situation. It will be held Thursday morning at 11 at the Oracle Community and Senior Center.

Isle of Man drug driving policy A campaign to educate people about the dangers of driving under the influence of drugs is being launched on the Isle of Man. Health officials want people to know about the effects of both illegal and legal drugs on motorists.
Cannabis can impair concentration and affect a driver's reaction times, but so can anti-depressants and painkillers, they said.
The launch was being held at Noble's Hospital on Wednesday.
The Department of Health and Social Security (DHSS) said many drivers were unaware of the dangers of driving under the influence of drugs.
It said the consequences were serious and fatal injuries to the driver, passengers and other road users, including pedestrians.
The Isle of Man Constabulary treats drug driving in the same way as drink driving

Dawn Henley, Senior Health Promotion Officer said: "Both illegal and medicinal drugs can impact on a driver's ability to drive safely.
"A driver may not realise until it is too late and as a consequence they are unable to react quickly to a hazard or situation on the road."
Health officials are urging those with prescription drugs to read the small print on their medicines.
Meanwhile, police say the penalties for those found drug-driving will be severe.
Sgt John Kinrade said: "The Isle of Man Constabulary treats drug driving in the same way as drink driving.
"The offence is the same, as are the penalties."

A loose collective of south London artists, DJs and fashion kids invade in a fluorescent flock for the first CRASH THE PLANE AND WALK AWAY party. Expect some electro-pop, punk funk, crunchy techno, distorted Parisian disco and rare glimpses of new-wave pop.
Performing on a custom-developed laptop rig is Ad Hoc, who spurns the studio to only play live, improvised sets, in a sustained attempt to demolish the dj/performance divide. From a vast audio vault, Ad Hoc builds unpredictable permutations of old school rave, grime acapellas, forgotten pop songs and digital glitches.
Meanwhile, the Coordinators will be crashing and walking away (vodka dependant) as they bring their own brand of quality house and partying south of the river to this launch event. Having recently rocked the backroom at Pacha London you can expect a riotous assault on house music that will have the crowd jumping nearly as much as the duo themselves.
Supporting all this madness will be a vast sequence of found art and still image projections created by the Ludovico Technique.
Also there will be Bez (in room 2), who will no doubt be up to his usual antics :)
As for the venue, Jamm has established itself as one of Brixton’s best-loved nightclubs where groups like Basement Jaxx and Twisted Melon have chosen to lay on their monthly parties. There’s a huge outdoor terrace, a lounge area (kitted out with sofas, a few plants, posters and a good-sized bar), and a main room made for blistering club nights.
We're sure you'll agree this is going to be one hell of a launch party, so see you there.
