REVIVED RAVE ACT PASSES Congress slips anti-club measure into child-abduction bill.

NEW ORLEANS—The correlation between baby-snatching perverts and pacifier-slinging music promoters is tenuous at best, but on April 10, the House and Senate approved a revived version of last year’s failed “RAVE Act” as part of the “Amber Alert” anti-child-abduction bill. The new law, the Illicit Drug Anti-Proliferation Act, was quietly folded into the measure by Senator Joseph Biden (D-DE).
As Section 608 of the “Amber Alert” bill, formally titled the PROTECT (Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today) Act, it broadly expands the federal “crackhouse law” (21 USC 856). That law already allows up to 20 years incarceration and $500,000 in fines for opening or maintaining a building for the purpose of manufacturing, distributing, or using an illegal drug. The new wording extends it to cover temporary, one-time, and outdoor events, and also allows the Feds to levy civil suits against promoters, with additional fines of up to $250,000 per offense. Civil suits have a lower threshold of proof, requiring only a “preponderance of evidence” instead of the “beyond a reasonable doubt” of criminal trials.
The Feds already used the crackhouse law in their landmark—though widely ridiculed—prosecution of New Orleans promoters Donnie Estopinal and brothers Brian and Robert Brunet in 2000. This year, the conviction and sentencing of Idaho promoter Lee Rice on the same charge earlier this year barely raised a whimper of protest. (See below.)
In these increasingly conservative political waters, Senator Biden has offered up concert promoters as chum for Attorney General John Ashcroft’s old school buddies. “Amber Alert is certainly the centerpiece of that act,” explains Chip Unruh, Biden’s spokesperson. “What binds them together—the purpose of that act—is to protect kids. As for slipping [the Illicit Drug Anti-Proliferation Act] in there, we don’t feel that we slipped it in there; it passed unanimously in the Senate Judiciary Committee. It would have gone through last year, but it was held up because of some judicial nominations.”
Last year’s RAVE Act was essentially the same bill, but contained explicitly anti-rave language; glowsticks and chill-out rooms were deemed evidence that promoters were aiding and abetting drug use. Two key sponsors withdrew after ravers sent tens of thousands of protest messages to Congress. Biden made a last-ditch effort to resurrect the bill in October, but it died. This year, the PROTECT Act as a whole was approved by the Judiciary Committee—where Biden is the top Democrat on the crime subcommittee—without hearings on the drug provisions.
“There’s sort of an alarmist attitude out there about this bill,” Unruh continues. “The Drug Policy Alliance claimed they had gathered so much opposition to it, and the ACLU, too. They’ve tried to scare people into believing that incidental drug use will be targeted.”
Indeed, the wording of the bill is so broad that Widespread Panic may eventually have to do Muzak renditions of “Tiny Bubbles” for Wal-Mart shoppers, rather than risk their fortunes by strumming live for fields full of tripping hippies. California landlords who allow little old ladies burdened with glaucoma to toke up at home could conceivably face forfeiture of their property. Cypress Hill might as well resign themselves to singing family tunes for Narcotics Anonymous conventions in Branson, Missouri. The potential nightmare that this bill poses was disturbing enough to prompt the Drug Policy Alliance to spearhead a drive that—once again—flooded Capitol Hill with over 30,000 letters in opposition to Section 608. Alas; to no avail. Still, the fight is far from finished.
“We’re turning our attention to enforcement issues,” says the DPA’s William McColl, unswayed by the setback. “I expect that at some point we’ll try to repeal it or change it. They’ve already prosecuted people who are innocent, and I expect them to prosecute more.”
Biden’s office denies that innocent rave promoters will be targeted, however. “This is no more anti-rave than the crackhouse law is anti-house. To prove that a promoter violated this law is an incredibly high bar,” insists Unruh. “A very small percentage of raves will be shut down because of this, and the ones that are will be the ones where unscrupulous promoters prey on young people by encouraging drug use. If you hold an event to distribute drugs, you will be held accountable.”
“There’s really an issue about the way they passed this,” sighs McColl. “I think we’d have a very different bill if they’d gone through committee. It’s unusual for it to go through with no vote, no hearing. They knew it was a major issue.”

IDAHO RAVE PROMOTERS JAILED
April Fool’s Day was no joke for rave promoters Lee Arthur Rice II and Kevin Pawlik. Rice received a seven-year federal prison sentence plus three years of probation and a $2,000 fine for conspiracy to distribute Ecstasy and LSD, as well as violating the “crackhouse law.” Pawlik got 17 years in the pen and six years of probation.
The two men are the first rave promoters to be found guilty at trial of knowingly allowing a venue to be used for the sale or consumption of drugs. The Feds initially used the crackhouse law in 2000 to prosecute concert promoters in New Orleans; that case was settled with a hefty fine. In 2001 they targeted Club La Vela (MTV’s spring-break headquarters from 1996-98) in Panama City Beach, Florida, but the defendants were acquitted.
Rice and Pawlik didn’t fare so well, however. Deputy US Attorney Monte Stiles claimed that Rice allowed codefendants Eric Shira and Tyler Nichol to use his VIP rooms to sell drugs during his music events in exchange for a kickback, an assertion that they all denied. Whether or not Rice will face criminal forfeiture of his properties, Lee’s Hip-Hop Boxing Club and Knockouts, remains to be seen. Meanwhile, he continues to adamantly proclaim his innocence, and is planning to appeal.

Oxon teens party becomes "illegal rave" This teenagers party which got a bit out of hand (earlier in the year) in an Oxfordshire vilage was reported as an "illegal rave!"

COMPUTER expert Dr. Nigel Geary has blamed 'cannabis culture' for an all-night illegal rave that wrecked his Henley home.
Dr. Geary returned from a week in America to discover his St. Mark's Road home in ruins after teenagers broke in and held a drink and drug binge on Valentine's Day.
Around 30 revellers partied from 7 p.m. on Saturday until the following morning. They helped themselves to all the food and drink in the house, sprayed walls with printers ink, ruined carpets, damaged furniture and electric appliances, broke down internal doors, raided drawers and stole cheques and credit cards. The cost in terms of damage and stolen property amounts to well over £10,000.
Neighbours reported seeing youths who 'looked about 15' drinking and talking loudly in the street. Some were even picked up by their parents from outside the house.
Dr. Geary said: "This is not the first time this has happened - a mansion on Harpsden Way was trashed in the same way just before Christmas. These kids find a house that's empty, word gets around, and they all turn up. It happens at the end of term and in school holidays.
"They act like animals. They use a lot of cannabis and they don't seem to know what they're doing - it's a cannabis crazed riot.
"There is a culture now. These kids come from good families and they go to good schools but they want to hang around and fool about with cannabis. It seems to me that almost every teenager in Henley is using cannabis, and the police don't seem to be doing anything about the dealers. The Government down grading it is just nonsense."
Dr. Geary is still uncovering the extent of the damage. He said: "They have trashed the place. They drank all the alcohol, including about £200 of whiskey, which I'd collected. The carpets have been ruined throughout, they took printers ink and sprayed it everywhere, they smashed open the door to my bedroom and forced open drawers.
"They took my daughter's violin, threw computer components in the trash - they even ripped apart the Hoover.
"All the carpets will need to be replaced, the walls repainted and I'll have to have the locks changed. I feel gutted - the house doesn't feel like mine any more.
"Initially, I thought it had just been kids having a party, but there were burglaries as well. Credit cards and cheques that I had locked away were stolen. They took an expensive watch, several house and mobile phones, and about 20 DVDs.
"We've got a couple of names already and the police took finger prints and removed the evidence of drug use. They're taking this very seriously.
"We want adults who came to pick up their children to come forward. Parents should know what their children are up to. This is the second house in three months that has been virtually destroyed ? they have to be stopped before this happens to someone else."
A spokesman for Thames Valley Police said: "We were called on February 16th when the owners returned and we found £7,500 worth of criminal damage and items of undisclosed value stolen. We are now investigating."

COPS raced to the Queen's Sandringham estate to find 500 revellers holding an illegal all-night rave.
A huge sound system had been set up in a woodland clearing after locks were broken on a gate.
Police monitored the party near Dersingham, Norfolk, but made no arrests in spite of a string of complaints about noise.
The racket could be heard from nearby Sandringham House - but the Queen was believed to be at Balmoral in Scotland.
A Sandringham worker said: "She will not be amused."

The home secretary is today set to detail how he intends to reduce crime by 15 per cent over the coming five years.
Following the spending review, David Blunkett is likely to detail a significant increase in street patrol officers.
The additional spending handed out by the chancellor will be used to cut nearly 900,000 offences in England and Wales.
With the support of the prime minister Blunkett is set to get tough on yob culture - with an assault on anti-social behaviour and drink related crime.
In a bid to signal the government's determination to tackle the yob culture Tony Blair said: "People do not want to return to old prejudices and to ugly discrimination. But they do want rules...where those who play by the rules are those who don't get punished."
Speaking to a Sunday newspaper the home secretary said he wanted to crack down on the "thuggery" associated with binge drinking.
Under the government's plans, the number of civilian police wardens will be increased to 20,000.
Ministers will also commit to the retention of the current 138,000 police officers.
The five-year plan, to be detailed in the Commons this afternoon, will also increase spending on youth projects in a bid to get young people off the streets.
Blunkett has echoed the remarks of Metropolitan Police Commissioner Sir John Stevens, who recently warned about "feral children".
The home secretary told the Observer that some of Britain's youths are "completely out of control".
New measures to combat the drugs menace will also be detailed by the home secretary.
The government believes the links between drugs and crime make it essential that a major funding boost is awarded to successful drug rehabilitation programmes.
Blunkett may also use his Commons statement and five year plan to detail proposals to establish the Serious and Organised Crime Agency - which will bring together the National Crime Squad, National Criminal Intelligence Service and elements of Customs and Excise.

This event, as has been the case with EVERY Earthdance event is a charity show for peace in aid of Tibet and the Tibetan house of trust. This year we also have added a local charity which helps children across the globe connect with each other in a unifying, positive way.
The mission of the Global Art Project (GAP) is to spread world peace by promoting tolerance and non-violence through art. The Project expresses the idea: We Are All One. People of all ages and from all around the world who choose to participate each create a work of art expressing their vision of global unity. The art is displayed locally in each participant's community. Global Art Project then organizes an international exchange by matching participants group-to-group and individual-to-individual.
The exchange occurs April 23-30 biennially, resulting in thousands of people sending messages of Peace and unity around the globe at one time--visions of unity simultaneously encircling the earth. The art is sent as a gift of global friendship and exhibited in the receiving community.
Participants may send slides and documentation of the art created and of the people who came together to create the art to the GAP Art Bank. Global Art Project exhibitions, books, slide presentations, and this Web site give people an opportunity to experience visions of Peace and unity created by individuals from diverse cultures around the world.

Police break up illegal rave From press reports

AN ILLEGAL rave in western Slovakia attended by 300 people was closed down by police.
The private news agency SITA reported that all of the revellers had left a meadow close to Borský Mikuláš village, Senica district, by the morning of July 8.
According to Martin Korch, Trnava district police spokesman, police cut off power to the illegal rave and appealed to the crowd to leave the area. Korch said that most of the 300 people at the rave had already left during the night. Police did not have to use force against the participants.
The techno fans arrived at the field on the evening of July 6. The party was a continuation of a Czech event called CzechTech, which the Czech police closed down. Like the Slovak event, CzechTech was not announced to the authorities in advance and it took place on private property. About 15,500 people attended the Czech event.
The area close to Borský Mikuláš belongs to a local agricultural cooperative. The area is also a nature reservation, where camping is prohibited.

"Shoppers in Swansea will this week join a trial of a high-tech ID card that could become compulsory under Home Office plans.
Volunteers are being asked to have fingerprints, irises, and facial details recorded as part of the UK Passport Service (UKPS) trial.
The experiment aims to weed out problems and get public feedback before the planned introduction date of 2007.
The mobile unit will be based at the Asda store in Morriston for the week.

It is the only Welsh trial as the UK Passport Service looks for 10,000 volunteers across the UK over six months.
Volunteers will get a demonstrator "smart card" containing their details on an electronic chip.
It is planned to include biometrics (facial features) in passports and to build a base for the national compulsory identity cards scheme.
There are objections to national ID cards among some.
Critics fear it might cause friction among ethnic minorities and set back race relations.
There are other fears that the cards might drive illegal immigrants into hiding.
Civil liberties campaigners say thousands of ordinary people could be criminalised if they refused to own the cards.
Home Office Minister Des Browne said those taking part in the Swansea trial would be playing an important role.
"Identity crime is a growing threat to all countries," he said.
"It costs the UK £1.3 billion a year, and facilitates organised crime, illegal immigration, benefit fraud, illegal working and terrorism.
"Only by planning ahead and taking steps now can we ensure that in the years to come we will be able to take on the increasingly sophisticated methods used by criminals.
"The government is to introduce a compulsory national UK identity card scheme to help tackle organised crime and protect the identities of British citizens.
"Using cutting-edge technology, the cards will link individuals' unique biometric data, such as iris scans, to a secure national database.
"The trial site being launched in Swansea is a vital part of this, laying the foundations for a robust and effective national identity card scheme."

Children will be tolerated under strict supervision of parents, the camping area is NOT lit and the terrain is NOT child friendly. The dance tent may be 2 or 3 minutes walk away from camping area. now its not often someone who's been an IT engineer for many years gets that excited about a bunch of IP addresses; but I've just literally seen everyone from the four corners of the world logging into here - this humble list of cryptic numbers translating into all these individuals and groups in search of the party, whatever country, state, city, town it is in
OK a lot of you lurk rather than post which is fair enough (particularly if you are in a country with less freedom to talk about raves and drugs etc!) but I hope you all find whatever you are looking for on this site and if its not there maybe you may consider helping to put it there?
