Ravegoers’ court case thrown out EDP 20 January 2006 06:00
Three men arrested during an illegal rave have seen the cases against them collapse.
Jye Blake, 22, Peter Graham, 19, and Ben Martell, 19, were charged with ignoring police orders to leave the party at North Creake, near Fakenham, in July last year.
The trio appeared before King's Lynn magistrates on Wednesday to begin a three-day trial after all pleading not guilty.
But the case was thrown out when prosecution lawyers realised they could not prove whether the defendants had been given enough time to leave the rave.
A spokesman for the Crown Prosecution Service said yesterday: "During the trial, new information came to light as to what a reasonable period would have been.
"This meant the case required a fresh review taking account of the timings of the arrests of the three suspects in this case.
"It was clear to the CPS at this stage that it could not be proved, so the court could be sure, that all three defendants were given sufficient time to disperse after the giving of the warning. This meant that the prosecution was not able to proceed with the case further and no evidence was offered against the three defendants."
Police seized thousands of pounds worth of audio equipment and records from the rave, which was attended by around 500 revellers.
Officers arrived at the site in the early hours of July 24 and ordered the partygoers to leave.
Later in the day, a squad of 40 police in riot gear returned to break up the event, arresting the three men.
A spokesman for Norfolk police said they would continue to take action despite the decision.
"Norfolk Constabulary will not accept the detrimental impact that these events have on the local community," he said.
Blake, of Stone Lane, Hingham, Graham, of Lammas Road, Tasburgh, and Martell, of Church Road, Tasburgh, were awarded costs by magistrates to cover loss of earnings and travel expenses.
The case was thrown out on Wednesday.

there is supposed to be a sensible explanation for this.
The entire pig (insides and all) is fluorescent - and the idea is that if boffins transplant material from this to other pigs the colour acts as an ID marker. It could also be used to try and stop GM modified pigs accidentally ending up in the food chain I suppose - it would be easy to spot the fluoro ones, and a dayglo pork chop isn't as appetising to most humans..
That said I can see them ending up as exotic pets and fashion accessories - it conjures up visions of a pig farmer and his fluoro animals being ordered out of a Shanghai nightclub by the Peoples Armed Police after dancing to hardhouse.

The uniqueness of the Mellout is made up of its textured creative journey, its spiraling energy, the fact that kids are welcome and the non smoking dance workshop vibe in the main room – an altogether ‘ripened’*concept in celebration.
This time featuring:
DJ Wombat who will be coaxing out the community in all of us with gently wavering tones from his collection of inspired ambiance.
Leading into the gentle African acoustics of Rukeza who will roll us on to a special treat. Rukiza is one of the old Mellout veterans so it is allway good to have him back!
Here at IDSpiral we are obsessed with innovation and so we are going to involve you all at the Mellout in the growing AllisOne dance experience (from 7.30 to 9.00pm) - lead by Five Rhythms dance teacher Chloe de Sousa - this time this will be at no extra charge and will be an invigorating event in itself.
The spoken word expert four this gathering will be the wondrous 'Whatsername'
exploring the truth of it all,
followed by Naomi Klein, a gifted dance performer, who explores varying techniques and cultural influences in her work.
Our chosen band of the evening is Priceless an all girl trio featuring guitar, flute. percussion & healing harmonies 2 uplift your soul.
This will lead us into a mighty psytrance finale with the dancing sounds of our old friend & partner in the fow of it all - Liquid Ross.
And remember the whole thing starts @ 4pm & finishes @ 12pm (one hour later than normal) come early & stay late !!!!!!!!!
